* Note: This is a one-year minimum contract and is auto renewing.

* Installs and replacements are not covered under the Service Pro Agreement.

* Inspection appointments can only be scheduled 6 months after the activation date. All other benefits will be applied.

* The annual inspection is only covered under warranty for 1 year as it is expected to be performed every year.

* It is the customers responsibility to book inspection visits.

HVAC & Heat Pump Service Membership Agreemen

1. Scope of Membership Coverage
This Service Membership Agreement (“Agreement”) is entered into between Brock’s Heating, Air Conditioning & Gas Services (“Brock’s”) and the undersigned customer (“Customer”) for the purpose of providing preventive maintenance and repair services for existing HVAC and heat pump equipment. Coverage applies only to equipment that is existing, operational, and serviceable at the time of enrollment and approved by Brock’s upon initial inspection.

2. Membership Benefits
Membership benefits may include scheduled preventive maintenance, system inspections, cleanings, performance testing, safety checks, diagnostic evaluation, repairs related to normal wear, and priority scheduling, subject to technician availability.

3. Exclusions and Limitations
This Service Membership does not include the supply, installation, or replacement of new HVAC or heat pump equipment, system upgrades, retrofits, electrical or structural modifications, or any repairs due to abuse, neglect, improper operation, unauthorized modification, acts of God, flooding, fire, freezing, lightning, or external causes. No membership discounts apply to the supply or installation of new or replacement equipment.

4. Equipment Replacement Policy
If Brock’s determines that existing equipment is unsafe, obsolete, or beyond economical repair, replacement may be recommended. All replacement equipment and labor shall be billed separately at standard pricing.

5. Priority Service
Members receive priority scheduling which provides preferred placement in Brock’s service queue. Priority service does not guarantee same-day service and is subject to availability, weather, and workload conditions.

6. Membership Term & Renewal
This Agreement is valid for a period of twelve (12) months from the enrollment date and shall automatically renew annually unless canceled in writing with thirty (30) days’ notice.

7. Payment Terms
Membership fees are due at the time of enrollment and are non-refundable once services have been rendered. Non-payment may result in suspension or termination of benefits.

8. Customer Responsibilities
Customer agrees to provide safe access to equipment, maintain proper operation, promptly report issues, and ensure a safe working environment.

9. Limitation of Liability
Brock’s shall not be liable for incidental or consequential damages, loss of use, or property damage resulting from equipment failure, pre-existing conditions, or manufacturer defects. Total liability shall not exceed the membership fees paid during the current term.

10. Cancellation
Either party may cancel this Agreement upon written notice. No refunds shall be issued after service has been provided.

11. Governing Law
This Agreement shall be governed by the laws of the State of Vermont.
